The agreement
Using the site means you accept these terms.
These terms are between you and Hearth Agency LLC ("Hearth," "we," "us"). "You" means the person using the site and, if you are acting for a firm, that firm. If you do not agree, do not use the site.
Professional work (a HearthRC Defense report, bookkeeping, practice-management delivery, or a Hearth Legacy Program engagement) also runs on written engagement terms agreed before that work starts. Where those terms and this page differ, the engagement terms govern the work. This page governs the website and the self-serve tools.
Who does what
Hearth builds the work. McGee's signs the professional side.
Hearth Agency LLC provides business advisory services and designs productized tax strategies. Tax architecture, tax preparation, accounting, and bookkeeping are delivered through McGee's Consulting LLC. Hearth Agency LLC is not a law firm, a CPA firm, or a registered investment advisor, and does not provide legal, tax, or investment advice.
Your firm stays the advisor of record for the clients you bring. Client-of-record and no-poach terms go in writing before any client is engaged.
The site
Information and tools, not advice for your facts.
Content on this site is general information. Calculators, sample reports, savings figures, and projections are illustrations. They are not a determination for any person or entity. Decisions belong in a conversation with a qualified professional who has your facts.
Accounts
You are responsible for the login you hold.
Some tools require an account (the workspace, the free platform calculator, the HearthRC intake). You agree the information you give at sign-up is accurate, you will keep the credentials to yourself, and you will tell us if you think the account was used without you. You are responsible for activity under the account.
If you enter client numbers or client facts, you represent that you have the right and any required consent to do that, including consent under IRC §7216 where it applies. Do not upload a tax return or a source document into a surface that is not built to hold it. The security page says which plane holds what.
Purchases
Published prices. Stripe checkout. Engagement terms for the work.
HearthRC Defense is sold on this site at the prices on the pricing page: $449 for a single report, $1,399 for the Premium Year of ten. Checkout runs through Stripe. A purchase is an order for that deliverable, on the details shown at checkout, for the account that bought it.
The report is produced for the firm or person on the order. Your firm reviews it, brands it, and bills its own client at its own rate unless you and Hearth agree otherwise in writing.
Refunds, redos, and turnaround, when they exist, are stated in the order or the engagement terms. Until those terms say otherwise, a completed report is not refundable except as required by law. If something is wrong with an order, write inquiry@hearthagency.io.
Acceptable use
Use the site for the work it is for.
Do not use the site to break the law, to probe or disrupt the systems, to scrape or harvest data, to upload malware, or to enter information you have no right to enter. Do not present a calculator result or a sample as a signed professional opinion. We may suspend or close access if these terms are broken.
Intellectual property
The site is ours. What you type is yours.
The site, the tools, the sample artifacts, the methodology write-ups, and the Hearth, HearthRC Defense, and Hearth Legacy Program names are owned by Hearth Agency LLC or its licensors. You may view them for your own evaluation and, if you are a partner firm, use the partner materials as the partner kit allows. You may not copy the site or the tools to run a competing service.
You keep the rights to information you submit. You give us a limited license to use it to reply, to run the tool you asked for, and to deliver the work. Feedback you send about the product may be used to improve it, with no obligation to pay you.
Limits
The site is provided as is.
We do not warrant that the site will be uninterrupted, error-free, or fit for a particular purpose. To the fullest extent the law allows, Hearth Agency LLC and McGee's Consulting LLC are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the site.
For claims that arise from a paid purchase on this site, our aggregate liability is limited to the amount you paid us for that purchase. For other claims about the site, our aggregate liability is limited to one hundred U.S. dollars. Some states do not allow these limits; in those states the limit is the maximum the law allows.
Governing law
Virginia law. Courts in Richmond.
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules. You and we agree that the state and federal courts located in Richmond, Virginia have exclusive jurisdiction, except where applicable law requires otherwise.
Changes
We post updates here.
We may change these terms by posting a new version on this page with a new date. If you have an account, we will also try to email the address on it when a change is material. Keep using the site after the new date and the new terms apply.
